Introduction

ViralZora Media Inc. ("ViralZora," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our website or services that are reported to our designated Copyright Agent.

This DMCA Policy outlines the procedures for reporting copyright infringement and our process for handling such claims. By using our Services, you agree to comply with this policy and all applicable copyright laws.

Good Faith: We take copyright infringement seriously and investigate all valid DMCA notices submitted to us. False claims may result in legal liability.

Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our Services, please notify our Copyright Agent. For your complaint to be valid under the DMCA, you must provide the following information in writing:

Only the copyright owner or an authorized agent may file a DMCA notice. If you are not the copyright owner, you must provide evidence of authorization to act on behalf of the owner.

Upon receiving a valid DMCA notice, we will:

  • Review the notice for completeness and accuracy
  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the content about the removal
  • Provide the user with information about filing a counter-notification

Required Information for DMCA Notice

To be effective, your DMCA notice must include the following:

  1. Physical or electronic signature of a person authorized to act on behalf of the copyright owner
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL)
  4. Contact information for the notifying party, including address, telephone number, and email address
  5. A statement that the notifying party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the notifying party is authorized to act on behalf of the copyright owner

Warning: Knowingly submitting a false or misleading DMCA notice may result in liability for damages, including costs and attorneys' fees, under Section 512(f) of the DMCA.

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. To be effective, a counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access disabled
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, any judicial district in which ViralZora may be found), and that you will accept service of process from the person who provided the DMCA notice or an agent of such person

Upon receiving a valid counter-notification, we will forward it to the original complaining party and inform them that the removed material may be restored after 10 business days, unless the copyright owner files an action seeking a court order against the content provider.

Repeat Infringers

In accordance with the DMCA and other applicable laws, ViralZora has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to our Services and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

A "repeat infringer" is a user who has been notified of infringing activity more than twice or has had infringing content removed from our Services more than twice.

Fair Use Policy

ViralZora acknowledges that copyright law provides for "fair use" of copyrighted materials for purposes such as criticism, comment, news reporting, teaching, scholarship, or research. We believe in the importance of fair use for journalism and public discourse.

When evaluating DMCA notices, we consider whether the use of copyrighted material constitutes fair use under Section 107 of the Copyright Act. Factors considered include:

  • The purpose and character of the use (commercial vs. non-profit educational)
  • The nature of the copyrighted work
  • The amount and substantiality of the portion used in relation to the copyrighted work as a whole
  • The effect of the use upon the potential market for or value of the copyrighted work

We encourage users to familiarize themselves with fair use principles before submitting or disputing DMCA claims.

  • Acknowledgment: Within 24-48 hours of receiving your notice
  • Initial Review: Within 3-5 business days
  • Content Removal (if valid): Within 5-7 business days of validation
  • Counter-Notification Response: Within 10-14 business days
